Consumer groups on both sides of the Atlantic say they’re worried proposed language in the Transatlantic Trade and Investment Partnership will allow American and European government officials to insert themselves into the drafting of each other’s regulations.

Businesses, meanwhile, worry the chapter won't do enough to instill regulatory cooperation.

The European Union’s latest plan for the so-called “horizontal” regulatory cooperation chapter in the deal calls for intergovernmental input before either side publishes proposed regulations — a relationship that would influence future regulatory work, as opposed to the sector-specific regulatory issues both sides are negotiating on the trade text itself.

“I don’t think [members of Parliament] will take kindly to being told, ‘No, we can’t change this because that’s what we agreed to with USTR,’ thereby undermining European democracy,” said Cecile Toubeau with Brussels-based NGO Transport and Environment.

An EU official told POLITICO that the Europeans are not pushing to see the texts of regulations or legislation before it’s made public: “But we think it’s important that regulators have the opportunity to have those dialogues at the earlier stage because it’s at those earlier stages when it is more possible to decide to what extent it is possible to develop an approach.”
